Umowa o Pracę vs Umowa Zlecenie: Which Contract is More Profitable for a Welder in Poland?
Which contract to choose when taking a job in Poland? We break down the pros and cons of Umowa o Pracę and Umowa Zlecenie: where the salary is higher, and where you get paid leave and sick pay.
When getting hired at a Polish factory, you will certainly be asked to sign a contract. Most often, this will be either an Umowa Zlecenie (Mandate Contract) or an Umowa o Pracę (Employment Contract).
There are eternal debates among foreign workers: which one is better? Some say you get cheated on a mandate contract, while others say the employment contract pays too little. The experts at Zvaryuvalnyk.xyz break it all down for you.
Umowa Zlecenie (Mandate Contract) – Maximum money "here and now"
This is the most popular contract for foreigners in their first year of work. Under this contract, you get paid for the exact hours you work.
Pros:
Higher Netto Rate: Taxes and contributions under this contract are often lower (especially for students under 26), so you get more "in hand."
Flexibility and Overtime: You can work 10-12 hours a day and come in on Saturdays. More hours = bigger paycheck. Terminating such a contract is also simpler and faster.
Cons: You do not have paid annual leave (urlop wypoczynkowy). If you get sick, sick leave (L4) is paid only if you voluntarily paid the "chorobowe" sickness contribution (you must ask the employer for this right away).
Umowa o Pracę (Employment Contract) – Stability and Social Guarantees
This is a full-fledged contract governed by the Polish Labor Code. The employer is obliged to guarantee your salary regardless of whether there is work at the factory.
Pros:
Paid Leave: From 20 to 26 days a year when you don't work but still receive your salary.
Paid Sick Leave (L4): If you fall ill, you receive 80% of your average salary.
Protection against dismissal: You cannot be fired overnight without a valid reason; a notice period (okres wypowiedzenia) applies.
Overtime (Nadgodziny) is more expensive: For work over 8 hours a day or on weekends, you are paid an additional +50% or +100% on top of your base rate.
Cons: The hourly net rate is usually lower due to higher taxes. Employers rarely offer this contract right away—first, you have to prove yourself on an Umowa Zlecenie. In addition, it is harder to work 250-300 hours a month on this contract due to the strict regulations of the Labor Code.
What to choose?
If your goal is to come for six months, work 12-hour shifts, and take maximum cash back home, your choice is Umowa Zlecenie.
If you plan to bring your family, get a mortgage from a Polish bank, have guaranteed weekends, and seek long-term stability—aim for an Umowa o Pracę.
